What you agree to when you use Podviva, and what we agree to.

Who this is between
These terms are between the company that operates Podviva, named in our legal notice, and the business that holds the account. If you accept them for a business, you are confirming you have authority to bind it.
Podviva is built for creators and businesses that publish shows. It is not offered to consumers for personal, family or household use.
What we provide
Podviva provides a podcast platform: recording, AI production, hosting, distribution, analytics and monetisation, with AI agents that act on the shows and systems you connect, inside the limits you set.
Podviva's agents are software. What they draft for your show is yours to review, and you must not present them, or a cloned voice, as a person.
We may add, change or retire features. If a change removes something you rely on, we will tell you in advance.
Your account
Keep sign in details to the people who should have them, and turn on the protections we offer, such as two factor sign in. You are responsible for what happens under your account.
Tell us straight away at [email protected] if you think your account has been accessed without permission.
What you are responsible for
The shows, feeds, accounts and systems you connect, and your right to connect them.
The instructions, sources and limits you give your agents, and checking that what they produce is right for your show.
Getting the consent of everyone you record, including guests, and of anyone whose voice is cloned. Some places require every party to a recording to agree to it.
Following the laws that apply to contacting people and disclosing sponsorship, including the Spam Act 2003 and the Do Not Call Register in Australia, the Telephone Consumer Protection Act in the United States, and equivalent laws where your listeners and sponsors are.
Having a lawful basis for any personal information you give us, and telling your listeners and guests how their information is used, including that you use Podviva.
What you must not do
Use Podviva to mislead listeners about who is speaking, to clone a voice without its owner's consent, to publish content you have no right to, to contact people who have asked you not to, to harass anyone, or to break the law where you or they are.
Use Podviva to give medical, legal or financial advice that someone will rely on without a qualified person reviewing it.
Upload payment card numbers, government identifiers or health information about other people, unless we have agreed in writing how it will be handled.
Resell Podviva as your own, work around usage limits, copy or reverse engineer the service, scrape it, or test it for weaknesses without our written permission.
AI output
AI agents can mishear, misunderstand or get something wrong. Review what they draft before it goes out, and keep a person in the loop for anything you cannot afford to get wrong.
Output is produced for your show. It is not professional advice, and we do not guarantee it is complete or accurate.
Your data
Your recordings, episodes, transcripts, feeds, listener data and sponsor records are yours. You give us permission to hold and process them only to provide, secure and support the service for you.
We never use your data or your listeners' data to train AI models, ours or anyone else's, and we choose providers and settings that keep it that way.
We use service measurements, such as upload volumes and processing times, to run and improve Podviva. They never include the content of your recordings.
Data protection
When we handle your guests' and listeners' personal information, we do it on your behalf and on your instructions. Under GDPR we are your processor, and under the CCPA we are your service provider.
Our privacy policy explains how personal information is handled. A Data Processing Addendum, including the EU Standard Contractual Clauses and the UK Addendum, is available at [email protected] and forms part of these terms once signed.
We keep a list of the providers that process personal information for us and will tell account holders before we add one that handles recordings.
We will help you respond to requests from your guests and listeners and meet your obligations if a data breach affects them.
Security and confidentiality
We protect your data with encryption in transit and at rest, access limited to the people and services that need it, and monitoring for misuse. No system is perfectly secure, and we will tell you promptly if a breach affects your data.
Each of us will keep the other's non public information confidential and use it only for this agreement.
Other services
Podviva works with services run by others, such as listening apps, Stripe and the tools you connect. Their terms apply to your use of them, and we are not responsible when one of them is unavailable or changes how it works.
Money
A subscription for your plan. Prices exclude GST and other taxes unless stated.
Your show's revenue, from ads, sponsors, subscriptions and tips, is paid out to the show through Stripe Connect, and we bill your plan separately. Refunds and payout changes always need a person.
We will give you at least thirty days notice of a price change. If an invoice is overdue, we may pause the service after telling you.
Stopping
You can stop at any time. For thirty days after you close your account you can export what we hold, and after that we delete it, except records the law requires us to keep.
We can suspend or close an account that is breaking these terms, putting others at risk or not paying. We will tell you why and, where we can, give you a chance to fix it first.
Liability
We provide the service as it is. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost data you could have kept, and our total liability is limited to what you paid us in the twelve months before the event.
Nothing in these terms excludes a right or guarantee you have under the Australian Consumer Law, or any liability that cannot lawfully be limited. Where a guarantee cannot be excluded, our liability is limited, where the law allows, to supplying the service again or paying for it to be supplied again.
You will cover us for claims that arise from your content, from using Podviva unlawfully, or from not getting a consent you were required to get.
Changes, law and disputes
If we change these terms in a way that matters, we will tell account holders at least thirty days before it takes effect.
These terms are governed by the law of New South Wales, Australia, and the courts of New South Wales have jurisdiction. Before going to court, each of us will try in good faith to resolve a dispute by talking first.
